In April, Hochman moved to withdraw Gascón’s recommendation, arguing that he did not believe the brothers had taken full responsibility for their crimes. This move was then rejected by Judge Jesic, paving the way for this week’s hearings to take place.

Erik and Lyle Menendez received a chance at freedom after more than 35 years in prison Tuesday, with a judge resentencing the brothers after relatives testified it was time for them to come home.

Lyle and Erik Menendez have been serving life in prison without parole in connection with the killings. A state parole board could now determine if and when the brothers are released.
